As you will remember the government are intending to expand the Freedom of Information (FOI) legislation to ensure that TMOs fall within its scope.
Up until now TMOs have been exempt from the requirements of the FOI but, with the introduction of the Social Tenant Access to Information Requirements (STAIRS) to social housing, including TMOs, owned by Housing Associations, it was felt that there is a need for tenants in homes managed by TMOs to also be able to access information about the way in which their homes are managed.
For TMOs in the housing association sector this will not affect you.
The government have announced a consultation exercise to consider the implications of extending the FOI to TMOs and how this might best be achieved and have written to all TMOs in England to set out their approach. Copies of the proposed approach and a covering note have recently been sent out and the NFTMO strongly urges all Members to respond to the consultation which will run until 8th May 2026.
The NFTMO will be responding to set out our concerns regarding the potential disproportionate impact this legislation may have on small organisation unless there is a mandatory requirement for landlords to play a role in managing enquiries.
